These Terms of Use ("Terms") govern your use of garofali.com (the "Site") and your purchase of products from GAROFALI® ("we," "us," "our"), operated by GAROFALI Limited Liability Company, a Delaware limited liability company. By using the Site or placing an order, you agree to these Terms.
If you do not agree to these Terms, do not use the Site or purchase from us. We may update these Terms from time to time, and the "Last updated" date above reflects the most recent revision. Continued use of the Site after a revision constitutes acceptance of the updated Terms.
Part One · Use of the Site
1. Eligibility
You must be at least 18 years old to use the Site or place an order. By using the Site, you represent that you are 18 or older and have the legal capacity to enter into these Terms. We do not knowingly accept orders from minors.
2. Accounts
You may create an account to make purchases and manage orders more easily. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.
3. Acceptable Use
You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You may not:
- Use the Site in any way that violates applicable law or regulation.
- Attempt to gain unauthorized access to the Site, related systems, or other users' accounts.
- Use any automated means to access the Site, including bots, scrapers, or crawlers, except for general search engine indexing.
- Interfere with the operation of the Site or any user's enjoyment of it.
- Use the Site to transmit malware, spam, or other harmful content.
- Reproduce, duplicate, copy, or resell any part of the Site or its content without our written permission.
4. Intellectual Property
All content on the Site — including product photography, copy, designs, logos, graphics, and the overall look and feel — is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, modify, distribute, or create derivative works from this content without our written permission, except that you may save and print pages for your personal, non-commercial reference.
The GAROFALI name, logo, and any product names are trademarks of GAROFALI Limited Liability Company. Other names and marks on the Site are the property of their respective owners.
5. User-Submitted Content
You may submit reviews, comments, photographs, or other content to the Site. By submitting content, you grant us a non-exclusive, royalty-free, worldwide, perpetual, sublicensable license to use, reproduce, modify, publish, and display that content in connection with the Site, our products, and our marketing. You represent that you own or have the right to submit the content and that it does not infringe the rights of any third party.
We may remove or refuse to display user-submitted content at our discretion, including content that is unlawful, offensive, misleading, or that violates these Terms.
6. Third-Party Links
The Site may contain links to third-party websites or services. We do not control and are not responsible for the content, policies, or practices of those third parties. Your interactions with them are governed by their own terms.
Part Two · Purchase and Sale
7. Product Information
We work to present products accurately, including descriptions, colors, sizing, and pricing. Despite our efforts, occasional errors may occur. Colors may appear differently on different screens. Sizing may vary slightly between styles. We reserve the right to correct errors, inaccuracies, or omissions in product information, including after an order has been placed, and to limit or refuse orders that result from such errors.
8. Pricing and Availability
All prices are shown in the currency selected on the Site at the time of order. Prices do not include shipping, taxes, or duties unless explicitly stated. We reserve the right to change pricing at any time, but changes will not affect orders that have already been confirmed. Product availability is not guaranteed, and we may limit quantities per customer or per order.
9. Orders and Payment
Placing an order is an offer to purchase, which we may accept or decline at our discretion. An order confirmation email indicates that we have received your order, not that we have accepted it. Acceptance occurs when we ship the order. We may decline orders for any lawful reason, including suspected fraud, errors in pricing or product information, or inability to ship to the requested address.
Payment is processed at the time of order through our third-party payment processors. You represent that you are authorized to use the payment method provided.
10. Shipping and Delivery
Shipping costs and estimated delivery times are shown at checkout. Title and risk of loss pass to you when we deliver the order to the carrier. We are not responsible for delays caused by the carrier, customs, weather, or other events outside our reasonable control. International orders may be subject to import duties, taxes, and fees imposed by the destination country, which are the responsibility of the customer.
11. Returns and Refunds
We accept returns and exchanges on full-price items that are unworn, unwashed, and undamaged, with all tags and hygiene liners intact and in their original packaging. For hygiene reasons, underwear and swimwear are final sale, as are all sale and clearance items — except as provided for EU and UK consumers under Part Four below.
To start a return, email us at contact[at]garofali[dot]com within 14 days of delivery with your order number. We will reply with return instructions and the return address. Approved items must be shipped back within 14 days of receiving those instructions, at the customer's expense using a trackable method; we are not responsible for returns lost or damaged in transit, and original outbound shipping is non-refundable.
Once we receive and inspect your return, eligible items are refunded as store credit within 14 business days, for the product price paid; original shipping and any surcharges are excluded. Exchanges are available for a different size or color, subject to availability — if the item you want isn't available, we will issue store credit instead.

12. Defective or Damaged Items
Every item is inspected before it ships. If your order arrives defective, damaged, or different from what you ordered, contact us at contact[at]garofali[dot]com within 14 days of delivery with your order number and a photo of the issue. We will cover return shipping and send a replacement or issue a full refund, including original shipping, at our discretion.
13. Promotional Codes and Offers
Promotional codes and offers are subject to the specific terms stated at the time of issuance. Unless otherwise stated, codes cannot be combined with other offers, are limited to one per customer, and have no cash value. We reserve the right to modify or cancel promotional offers at any time and to refuse to honor codes that we reasonably believe have been obtained or used in bad faith.

14. Disclaimers
THE SITE AND THE PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site is free of viruses or other harmful components. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL GAROFALI LIMITED LIABILITY COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THE PRODUCTS, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR ANY PRODUCT WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
16. Indemnification
You agree to indemnify, defend, and hold harmless GAROFALI Limited Liability Company, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or related to your breach of these Terms, your misuse of the Site, your violation of any law or the rights of any third party, or any content you submit to the Site.
17. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
18. Dispute Resolution and Arbitration
Most concerns can be resolved informally. Before filing any formal claim, you agree to first contact us at contact[at]garofali[dot]com and provide a written description of the dispute and the relief sought. We will attempt to resolve the dispute informally and in good faith within sixty (60) days of receiving your notice.
If we cannot resolve the dispute informally within that period, any claim arising out of or related to these Terms or your use of the Site will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as then in effect. The arbitration will take place in New York, New York, or by remote proceeding where the AAA Consumer Arbitration Rules permit. The arbitrator's award is final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AND WE EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.
Notwithstanding the above, either party may bring a claim in small claims court if the claim qualifies, and either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.
19. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Site ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.
20. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
21. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced on the Site, constitute the entire agreement between you and us regarding the Site and the products, and supersede any prior agreements on the same subject.

Part Four · Additional Terms for EU Consumers
This Part applies only to consumers located in the European Union. If you are purchasing from outside the EU, Part Four does not apply to you.
23. EU Right of Withdrawal — Overview
If you are a consumer resident in the European Union, you have the right to withdraw from your purchase of eligible products within 14 calendar days of the date on which you receive your order, without giving any reason. This right is provided under EU Directive 2011/83/EU (the Consumer Rights Directive), as amended by EU Directive 2023/2673.
Exercising the right of withdrawal cancels your purchase contract. To initiate a withdrawal, follow the process described in Section 25 below.
24. Products Covered and Products Exempt
The right of withdrawal applies to all GAROFALI products, including underwear and swimwear. Because these items are not sold with a hygiene seal, the health and hygiene exemption under Article 16(e) of EU Directive 2011/83/EU does not apply to them, and they remain eligible for withdrawal provided they are returned unworn, unwashed, and undamaged, with all original tags intact.
Sale and clearance items are final sale regardless of product category and are not subject to the right of withdrawal.
25. How to Exercise Your Right of Withdrawal
To exercise your right of withdrawal, notify us at contact[at]garofali[dot]com within 14 days of delivery, with the subject line "EU Withdrawal Request." Include your full name and the order number for the contract you wish to withdraw from. The withdrawal period is met if you send your communication before the 14-day period has expired.
We will acknowledge your withdrawal notice and provide return instructions, without undue delay. This acknowledgement confirms that your withdrawal notice has been received and records the date and time of your request.
26. Your Obligations Following Withdrawal
If you withdraw from your purchase, you must return the eligible products to us without undue delay, and no later than 14 days from the date on which you communicated your withdrawal notice. You bear the direct cost of returning the products. Products must be returned to:

You are responsible for any diminished value of the products resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning. Products that have been worn, washed, or damaged beyond reasonable inspection will not be accepted for a full withdrawal refund.
27. Refunds Following Withdrawal
We will reimburse all payments received from you for the withdrawn products, including the cost of standard outbound delivery (if charged), no later than 14 days from the date on which we receive the returned products, or from the date on which you supply evidence of having shipped them back, whichever is the earlier.
We will issue the refund using the same payment method you used for your original purchase, unless you have expressly agreed otherwise. We may withhold reimbursement until we have received the returned products or received evidence that you have sent them back.
We are not required to reimburse supplementary costs if you chose a delivery method other than the least expensive standard delivery method we offer.
